The letter closes an earlier process
In many organisations, the claims function is engaged only when a letter has to be drafted. By then, decisions have already been taken and information has passed through several filters. The quality of the final document cannot recover every option lost earlier.
Risk begins at the source of information
A mature system starts where the event occurs. The person responsible for contractual risk should be able to see facts before they are fully interpreted, test them against the contract, identify evidential gaps and determine what action is needed now — not only after consequences have materialised.
Different perspectives are necessary
Delivery teams focus on execution, time and resources. The contract function simultaneously assesses responsibility, notice requirements, evidence, programme and cost impact, and the risk of losing rights. Maturity is not one perspective defeating another; it is the organisation’s ability to resolve the difference deliberately.
AI cannot replace a missing fact
AI can search documents, build chronologies and flag inconsistencies. It cannot recreate information that was never recorded or repair a process in which a material signal was dismissed too early.
Can the organisation recognise the point at which it must begin protecting its position — before available options disappear?
